    Throughout these Terms of Service, the terms “Sacria Atelier,” “we,” “us,” and “our” refer to Sacria Atelier LLC.

    These Terms of Service govern your access to and use of the Site and your purchase of products from Sacria Atelier. By accessing the Site, creating an account, or placing an order, you agree to these Terms of Service and to the policies incorporated into them, including our Shipping Policy, Return and Refund Policy, and Privacy Policy.

    If you do not agree to these Terms, you should not use the Site or place an order.

    Nothing in these Terms limits or excludes any consumer rights that cannot legally be waived or restricted under the laws applicable to you.

    1. ELIGIBILITY AND USE OF THE SITE

    By using the Site, you confirm that you have reached the legal age required to enter into a binding agreement in your place of residence, or that you are using the Site with the permission and supervision of a parent or legal guardian.

    You may not use the Site or our products for any unlawful or unauthorized purpose. You must not transmit malicious code, interfere with the operation or security of the Site, attempt to gain unauthorized access to the Site, or use the Site in a way that violates applicable law or the rights of another person.

    1. SHOPIFY PLATFORM

    Our online store and checkout are hosted and supported by Shopify. Shopify provides the e-commerce platform that enables us to display and sell our products and process orders.

    Your information may be processed by Shopify and other service providers as described in our Privacy Policy.

    We do not guarantee that the Site will always operate without interruptions, delays, or technical errors.

    1. PRODUCTS AND PRODUCT INFORMATION

    Sacria Atelier products are designed and produced using artisanal techniques. Many products are handmade, hand-finished, produced in limited quantities, or created from natural materials.

    Because of the handmade nature of our products, minor variations in color, texture, print placement, dimensions, stitching, surface finish, or other artisanal details may occur. Such minor variations are part of the individual character of the product and are not considered defects unless the product materially differs from its description.

    We make reasonable efforts to display product colors and details accurately. However, colors may appear differently depending on the device, screen, lighting, and display settings used by the customer.

    Product measurements are approximate unless expressly stated otherwise.

    We reserve the right to change or discontinue products, designs, prices, descriptions, and availability without prior notice.

    1. PRODUCT AVAILABILITY AND MADE-TO-ORDER ITEMS

    Certain products may be available for purchase while they are being produced, temporarily out of immediate stock, or made to order.

    The ability to place an order does not always mean that the product is immediately available for dispatch.

    If an item requires additional production time or cannot be dispatched within the stated timeframe, we will contact you with an updated estimate. Where required by applicable law, you will be given the option to accept the revised timeframe or cancel the affected item for a refund.

    We may limit the quantities available to any customer, order, household, geographic region, or jurisdiction.

    1. ORDERS AND CONTRACT FORMATION

    Placing an order constitutes an offer to purchase the selected products under these Terms.

    An automated order confirmation acknowledges that we have received your order but does not necessarily constitute final acceptance of the order.

    An order is accepted when we confirm that it has entered fulfillment or when the order is dispatched, whichever occurs first.

    We reserve the right to decline or cancel an order before acceptance for reasons including:

    • product unavailability;

    • incorrect product or pricing information;

    • suspected fraud or unauthorized payment;

    • payment verification problems;

    • delivery restrictions;

    • sanctions or legal restrictions;

    • suspected commercial misuse of the Site; or

    • an inability to fulfill the order safely or lawfully.

    If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled product and any corresponding shipping charge as required by applicable law.

    1. PRICES, CURRENCIES, AND PAYMENT

    Product prices are displayed on the Site and may be shown in different currencies depending on the customer’s market or location.

    The final price, currency, shipping charge, applicable tax, and order total are displayed at checkout before payment is submitted.

    Currency conversion rates may change. A customer’s bank, card issuer, or payment provider may apply its own exchange rate or additional transaction fees. Sacria Atelier does not control these external fees.

    Payment must be completed using one of the payment methods available at checkout.

    We reserve the right to correct genuine pricing or product information errors. If an error affects an order that has already been placed, we will notify the customer and provide the option to confirm the corrected order or cancel it for a refund.

    1. SHIPPING AND DELIVERY

    Orders are fulfilled from Baku, Azerbaijan.

    Shipping destinations, methods, prices, processing times, estimated delivery times, local delivery conditions, and pickup arrangements are described in our Shipping Policy:

    Delivery dates are estimates unless expressly stated otherwise. Customs processing, carrier disruptions, weather, public holidays, or events outside our reasonable control may cause delays.

    Customers are responsible for providing complete and accurate shipping and contact information.

    If we become unable to ship an order within the stated or agreed timeframe, we will contact the customer and provide the options required by applicable law.

    1. DUTIES, IMPORT TAXES, AND CUSTOMS CLEARANCE

    International orders are shipped on a Delivered at Place (DAP) basis unless expressly stated otherwise at checkout.

    Import duties, import taxes, VAT, customs clearance charges, and carrier brokerage or disbursement fees are not collected or prepaid by Sacria Atelier.

    Any such charges assessed by the destination country, customs authorities, or shipping carrier are the responsibility of the recipient and must be paid directly to the relevant authority or carrier when requested.

    These charges are separate from the product price and shipping charge paid to Sacria Atelier.

    1. RETURNS, EXCHANGES, AND REFUNDS

    Returns, exchanges, eligibility requirements, exclusions, return authorization procedures, and refund processing are governed by our Return and Refund Policy:

    Customers must contact us before sending a product back. Products returned without prior authorization may not be accepted.

    We do not provide prepaid return shipping labels. Return shipping costs are the responsibility of the customer, except where otherwise required by applicable law.

    Customized, personalized, made-to-order, sale, or other excluded products may not be eligible for return, as specified in the Return and Refund Policy and subject to applicable mandatory consumer law.

    Nothing in our Return and Refund Policy or these Terms limits any statutory rights relating to defective, damaged, incorrectly supplied, or non-conforming products.

    1. INTELLECTUAL PROPERTY

    The Site and its contents—including the Sacria Atelier name, trademarks, logos, product designs, textile patterns, artwork, photographs, videos, graphics, text, packaging, and website design—are owned by or licensed to Sacria Atelier and are protected by applicable intellectual property laws.

    You may access and use the Site for personal, non-commercial shopping purposes.

    You may not copy, reproduce, modify, distribute, publish, sell, license, commercially exploit, or create derivative works from any part of the Site or its contents without our prior written permission.

    Purchasing a Sacria Atelier product does not transfer any intellectual property rights in the product design, artwork, print, pattern, packaging, or related materials.

    1. CUSTOMER CONTENT AND SUBMISSIONS

    If you submit a review, photograph, comment, suggestion, or other content to us or through the Site, you confirm that you own the content or have permission to submit it.

    You grant Sacria Atelier a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for the operation and promotion of our business, unless otherwise agreed in writing.

    We may remove content that is unlawful, misleading, defamatory, infringing, abusive, or otherwise inappropriate.

    1. THIRD-PARTY SERVICES AND LINKS

    The Site may contain links to or integrations with third-party websites, payment providers, social networks, shipping carriers, and other services.

    These services are operated independently and may be governed by their own terms and privacy policies.

    To the extent permitted by law, Sacria Atelier is not responsible for the availability, content, security, or conduct of third-party services that we do not control.

    By using the Site, you acknowledge that your information may be processed by Shopify, payment providers, shipping carriers, and other service providers as necessary to operate the Site, process payments, fulfill orders, prevent fraud, and provide customer service.

    1. DISCLAIMER OF WARRANTIES

    We make reasonable efforts to ensure that product information and Site content are accurate and current.

    Except for warranties expressly stated by us and warranties that cannot be excluded under applicable law, the Site is provided on an “as available” basis.

    We do not warrant that access to the Site will always be uninterrupted, secure, or error-free.

    This section does not exclude any legal guarantee or statutory warranty applicable to products purchased by a consumer.

    1. LIMITATION OF LIABILITY

    To the maximum extent permitted by applicable law, Sacria Atelier will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the Site or purchase of a product.

    Where liability may lawfully be limited, our total liability relating to a particular order will not exceed the total amount paid to Sacria Atelier for that order.

    These limitations do not apply to liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct, gross negligence, personal injury caused by negligence, or mandatory consumer protection law.

    1. EVENTS OUTSIDE OUR CONTROL

    We are not responsible for delays or failure to perform caused by circumstances outside our reasonable control, including natural disasters, war, civil disturbance, government action, customs restrictions, transportation disruption, carrier failure, labor disputes, epidemics, power outages, or failures of telecommunications or payment systems.

    If such an event materially delays an order, we will provide information and remedies required by applicable law.

    1. GOVERNING LAW AND DISPUTES

    These Terms and any dispute arising from them are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

    Before initiating formal proceedings, you agree to contact us at support@sacriaatelier.com and allow a reasonable opportunity to resolve the matter informally.

    Subject to any mandatory rights available to a consumer, disputes that cannot be resolved informally will be submitted to the competent state or federal courts located in Wyoming, United States.

    If the mandatory consumer laws of your country or region give you the right to rely on local consumer protections or bring proceedings in another competent forum, nothing in these Terms removes those rights.

    1. CHANGES TO THESE TERMS

    We may update these Terms from time to time to reflect changes to our business, Site, products, policies, or legal obligations.

    The updated Terms will be published on this page with a revised “Last updated” date.

    Changes will apply prospectively. Orders already accepted will generally remain governed by the version of the Terms in effect when the order was placed, unless applicable law requires otherwise.

    1. SEVERABILITY AND NO WAIVER

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

    Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

    These Terms, together with the policies referenced in them and any additional terms presented at checkout, constitute the agreement between you and Sacria Atelier concerning your use of the Site and purchase of products.

    If these Terms are translated into another language and a conflict arises between versions, the English version will control, except where applicable law requires otherwise.
